Terms of Service
These terms govern your access to and use of Malta Brokering. By creating an account or using the platform, you accept them in full.

1. Who we are
Malta Brokering ("we", "us", "our", or "the platform") is a service that connects property brokers, who may be based anywhere in Europe, with licensed real estate agents operating in Malta. We facilitate introductions and provide software tools to submit, assign and track them.
We are not a licensed estate agency, and we do not value property, conduct viewings, negotiate, or carry out any regulated estate agency work ourselves. All such work is performed by the independent licensed agent to whom a lead is assigned.
2. Accounts & eligibility
You must be at least 18 years old and able to enter into a binding agreement to use Malta Brokering. When you register you agree to:
- provide accurate, current and complete information, and keep it up to date;
- verify your email address using the one-time code we send you;
- keep your password confidential and not share your account; and
- take responsibility for all activity that occurs under your account.
Agents must hold a valid licence to practise as a real estate agent or property consultant in Malta and may be asked to evidence this before receiving assignments. If your licence lapses or is revoked, you must stop accepting assignments and tell us.
3. How the referral model works
A broker introduces a potential client (a "lead") to the platform. Our team reviews each lead and assigns it to a single licensed agent, who carries out all regulated work. We act only as the point of coordination between them.
To protect the privacy of both sides, brokers are never shown the identity of the assigned agent, and agents are never shown the identity of the referring broker. Communication and updates pass through the platform.
Submitting a lead does not guarantee a deal, an assignment, an assignment timeframe, or any particular outcome. You confirm that any personal data about a client that you submit has been provided with that client's knowledge and, where required, their consent, and that you are entitled to share it with us for this purpose.
Sections 4 and 5 set out the terms that apply specifically to each role. The rest of this agreement applies to all users. Where a role-specific term conflicts with a general term, the role-specific term prevails for that user.
4. Broker terms
These terms apply to you when you use Malta Brokering as a broker.
- You may be based anywhere in Europe and you do not need a licence; you introduce leads, you do not perform regulated estate agency work.
- You submit only genuine leads for people who are genuinely considering buying, selling, letting or renting property in Malta, and only where you are entitled to share their details with us.
- You will not use the platform to give valuations, negotiate, or otherwise act as an agent.
- You will not attempt to identify the assigned agent or deal with the client "off-platform" to avoid your agreed commission split.
- Where a lead you introduced completes, you are credited and paid your agreed share of the commission, as described in section 7.
- Access is immediate: once your email is verified, your broker dashboard is active.
5. Agent terms
These terms apply to you when you use Malta Brokering as a licensed agent, in addition to the broker-facing protections above.
- You must hold a valid licence to practise as a real estate agent or property consultant in Malta, keep it current, and evidence it on request. If it lapses or is revoked, you must stop accepting assignments and tell us.
- Agent accounts are subject to manual review. Your account is created in a "pending" state and cannot receive or work leads until we approve it; we may decline or later revoke approval at our discretion.
- Each lead assigned to you is yours exclusively: you must not resell, share, or transfer it, and you carry out all regulated work in compliance with Maltese law.
- You respond to a new assignment within one working day and keep the dashboard honestly updated so brokers and our team see real progress.
- You handle all client personal data lawfully and only for the purpose of progressing the transaction.
- You honour the agreed commission split and pay the broker's share once a deal completes.
6. Acceptable use
When using Malta Brokering you agree to:
- submit only genuine leads with a real prospect of a transaction;
- not attempt to identify, contact around, or otherwise circumvent the platform to avoid an agreed commission split;
- not submit false, misleading, unlawful, discriminatory or infringing content;
- not upload malware or attempt to disrupt, probe, or gain unauthorised access to the platform; and
- comply with all applicable laws, including data-protection and anti-money-laundering rules.
7. Fees & commissions
Creating an account and submitting or receiving leads is free. Where a lead results in a completed transaction, the broker receives an agreed share of the commission. The specific terms of any split are confirmed transparently before a deal progresses, and any payment obligations run between the parties to that transaction. Nothing on this platform constitutes financial, tax, legal or investment advice.
8. Intellectual property
The Malta Brokering name, logo, software, design and content are owned by us or our licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable right to use the platform for its intended purpose. You retain ownership of the information you submit, and you grant us the licence needed to host and process it in order to provide the service.
9. Liability & disclaimers
The platform is provided on an "as is" and "as available" basis, without warranties of any kind. To the fullest extent permitted by law, we are not liable for the conduct of any broker, agent or client, for the outcome, timing or lawfulness of any transaction, or for any indirect, incidental or consequential loss, loss of profit, or loss of opportunity. Nothing in these terms limits any liability that cannot be limited under applicable law, including for death or personal injury caused by negligence or for fraud.
10. Suspension & termination
We may suspend or close an account that breaches these terms, misuses the platform, or where an agent's licence lapses, and we may remove content that we reasonably believe is unlawful or in breach of these terms. You may close your account at any time by contacting us. Provisions that by their nature should survive termination, including those on liability, intellectual property and governing law, will continue to apply.
11. Governing law
These terms are governed by the laws of Malta, and the courts of Malta have exclusive jurisdiction over any dispute arising from them, without prejudice to any mandatory consumer-protection rights you may have where you live.
12. Changes & contact
We may update these terms from time to time; material changes will be reflected by the "last updated" date above and, where appropriate, notified to you. Continued use of the platform after a change means you accept the updated terms.
